Last updated: [date] Effective for all services offered by Sundance Solar Pvt Ltd ("Sundance," "we," "us," "our") via www.sundancesolar.in and any associated consultation, quotation, or booking process.
1. About Sundance Solar Pvt Ltd
Sundance Solar Pvt Ltd is a rooftop solar installer, registered/empaneled with UPNEDA/UPPCL. and other applicable DISCOMs, for installation of rooftop solar systems under the MNRE Rooftop Solar Programme (PM Suryaghar). Registered/functional office: 16- Acock, Pochanpur Village, Dwarka- 110077 and 1601, Tower 06, Valley View Estate, Gwal Pahari, Gurgaon – 122003. Regional office: SK-18, Sector-117, Gautam Buddha Nagar.
2. Acceptance of Terms
By using this website, requesting a consultation, or booking an installation with DDIN, you agree to these Terms of Service. Where you go on to sign a formal Vendor-Buyer Agreement ("the Agreement") for installation, the Agreement governs your specific project — these website Terms apply to your general use of the site and our services up to that point, and continue to apply for anything the Agreement doesn't cover.
3. Services Offered
DDIN provides end-to-end rooftop solar services: site assessment, system design, DCR-compliant module and inverter procurement, installation, commissioning, subsidy facilitation, net-metering liaison with DISCOMs, and post-installation maintenance (AMC), for residential, housing society, and small industrial/commercial customers.
4. Consultation & Quotation
- Initial consultation and site assessment are free of cost.
- Any quotation, drawing, specification, or design shared before signing is an estimate only and does not constitute a binding offer. Descriptive specifications, illustrations, fact sheets, and price lists shared by Sundance are approximate.
- No work, procurement, or commitment begins until a formal Agreement is signed by both parties.
5. Booking & Agreement
- A project is confirmed only once the Vendor-Buyer Agreement is signed by the Applicant and Sundance.
- The Agreement sets out system capacity, module/inverter specifications, price, payment schedule, warranty, and maintenance terms specific to your installation, and takes precedence over this general Terms of Service for anything it specifically addresses.
- Once signed and uploaded to the PM Suryaghar Portal, the Agreement is binding on both parties. See our Return & Refund Policy for cancellation terms.
6. Pricing & Payment
- Standard payment structure: an advance on order confirmation, a further payment against Proforma Invoice before dispatch of materials, and a final payment on installation and commissioning — as detailed in your signed Agreement.
- All payments must be made via banker's cheque, NEFT, RTGS, or an online payment portal intimated by Sundance. No cash payments are accepted.
- Order value and payment terms, once fixed in the Agreement, are not subject to adjustment except by mutual written agreement.
7. Applicant/Customer Responsibilities
By booking a project, you confirm and agree that:
- You have the legal right to authorize installation at the site (ownership, or authorization from the owner/society).
- All information you provide — load profile, electricity consumption, power bills, site details — is true and accurate; Sundance's design and quotation rely on this information.
- The site's electrical and plumbing infrastructure complies with applicable law, and you will provide reasonable access, power, water, and storage facilities needed for installation.
- You will keep the site shadow-free and free of encumbrances for the system's operating lifetime, and will maintain regular cleaning/accessibility as required.
- Drawings, specifications, or plans shared by Sundance are deemed approved if you do not respond with objections within 5 days of receipt.
8. System Specifications & Compliance
- All solar modules, inverters, and Balance of System (BoS) components will meet MNRE's minimum specification and DCR (Domestic Content Requirement) norms.
- Module mounting structures are designed to withstand minimum wind load as specified by MNRE.
- Exact make/model/capacity of components will be as specified in your signed Agreement.
9. Installation Timelines
Any installation timeline communicated — including the standard 4-6 week estimate — is indicative only. Sundance is not liable for delays not attributable to Sundance (e.g., DISCOM processing time, site readiness, force majeure events).
10. Warranty
- Product Warranty: Limited to the warranty extended by the original manufacturer of the modules, inverter, and other components.
- Installation Warranty: DDIN warrants workmanship and BoS installation to be free of defects for five years from installation, provided defects are reported in writing within 15 days of occurrence.
- Performance Guarantee: A minimum system performance ratio of 75% is guaranteed for five years, tested per IEC 61724 or equivalent BIS standards — subject to proper maintenance and a shadow-free site.
- Warranty does not cover damage from unauthorized modification, misuse, neglect, non-compliant usage, failure to maintain, normal wear and tear, or force majeure events.
11. Maintenance
Sundance provides five years of free workmanship maintenance from commissioning, including at least one site visit per quarter to inspect nuts/bolts, fuses, earth resistance, and general system health. Routine cleaning and dusting is the customer's responsibility.
12. Subsidy & Net Metering
Sundance facilitates the government subsidy application and net-metering process with the relevant DISCOM on the customer's behalf. Sundance does not control DISCOM or government processing timelines and is not liable for delays or denials outside its control, though we will make reasonable efforts to resolve issues on your behalf.
13. Risk of Loss – Delivered Material & Post-Handover
- Between material delivery and installation: Once solar modules, inverters, or any Balance of System (BoS) components are delivered to the customer's site, responsibility for their safekeeping — including any theft, loss, or breakage — passes entirely to the customer, until Sundance's installation team arrives to begin installation. Sundance is not liable for any loss or damage to delivered material occurring during this interim period.
- After project handover: Once the installation is complete and the system is handed over to the customer, full responsibility for the system's safekeeping — including theft, breakage, or damage — rests with the customer. This is separate from Sundance's workmanship warranty and performance guarantee (Section 10), which continue to cover manufacturing and installation defects, but do not cover loss, theft, or damage caused by external events, negligence, or third parties.
- The customer is encouraged to arrange appropriate insurance coverage for the system, particularly for the interim storage period and post-handover, as Sundance's own insurance coverage (where applicable) ends at the point of delivery/handover as detailed in the signed Agreement.
14. Site Access
By signing the Agreement, you grant Sundance and its authorized personnel/subcontractors the right to access your site for site assessment, delivery/storage of materials, installation, inspection, and maintenance/repairs, for the duration of the project and warranty period.
15. Marketing & Use of Site Content
Unless you notify Sundance in writing otherwise, DDIN may photograph, geo-tag, and use the installation site and project as part of its marketing and promotional activities, across any platform, at its discretion.
16. Limitation of Liability
Sundance's liability for any breach of these Terms or the Agreement is limited to repair/replacement of the affected system or component, or refund of amounts paid where DDIN cannot fulfil the order — as further detailed in your signed Agreement. DDIN is not liable for consequential, indirect, or incidental damages.
17. Force Majeure
Neither party is liable for delay or failure to perform obligations arising from events beyond reasonable control — including but not limited to war, riot, civil disorder, earthquake, fire, flood, pandemic, strikes, labour disputes, government action, or vendor equipment unavailability.
18. Website Use
Content on www.sundancesolar.in — text, images, pricing calculators, and design — is the property of Sundance Solar Pvt Ltd and may not be reproduced without permission. Website content, including savings estimates and pricing ranges, is indicative and subject to actual site assessment.
19. Governing Law & Dispute Resolution
These Terms and any Agreement executed with Sundance are governed by the laws of India. Disputes will first be addressed in good faith between the parties; failing resolution, disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator mutually appointed by both parties.
20. Changes to These Terms
DDIN may update these Terms from time to time. Changes will be posted on this page; continued use of our website or services after changes constitutes acceptance. Terms already fixed in a signed Agreement are not affected by later website updates.
